With GM and Chrysler restructuring in bankruptcy after filing for Chapter 11, both motor companies have been freed from legal obligation for current and pending lawsuits.

This has left numerous victims, who’ve been severely injured due to mechanical errors or structural vehicle failures, in the lurch without much recourse for financial compensation.

Roughly 14,548 claims were filed against GM and Chrysler in the past five years alleging injury or death, according to Safety Research & Strategies.

"These claims are going to be wiped out," said Sean Kane, president of SRS.

A perfect example is back in 2007, 10-year-old Amanda Dinnigan was riding in a GMC vehicle when the car hit a tree, according to newsday.com. As a result of the accident, Amanda was left a quadriplegic and her family sued GM alleging the vehicle's seat belts were defective. The chances of Amanda collecting any financial compensation to cover treatment and/or recuperation are slim and none.

Unfortunately, Amanda’s story will become all too common in the months and years to come. The average combined casualties per year for both GM and Chrysler is 3,415. These claims are expected to continue at the same pace while the companies are reconfiguring in bankruptcy. This will result in roughly 3,400 new casualties each year in the next few years, according to SRS.

As an injury lawyer with 20 years of experience representing clients who’ve been severely injured in car accidents , I think it’s outrageous GM and Chrysler are essentially getting a free pass from their legal obligation to these victims by the bankruptcy courts.

Jim, I couldn't agree with you more re GM's & Chrysler's bankruptcy. However, it struck a sour note with me when you said, "This has left numerous victims who've been severely injured due to mechanical errors or structural vehicle failures, in the lurch without much recourse for financial compensation. How would you feel if you were severely injured or died from a faulty mechanical device and had NO recourse for financial compensation? This is reality with faulty mechanical/medical devices and in particular, Medtronic, who remains very solvent and not in bankruptcy. Ask the family of Mark Turnidge, for instance, who died at the age of 33, when they attempted to extract his fractured Sprint Fidelis lead manufactured by Medtronic. They have NO recourse in the courts. I will take this opportunity to encourage each and everyone of you to read the Medical Device Safety Act S540/HR 1346 and solicit support from your Congressmen/Women and Senators. I also ask you to sign and leave comments on the Medical Device Safety Act Petition which can be found at

I am sure that President Obama will rectify the situation with GM & Chrysler. Who is going to look after us?

Jill,

This is Wendy, Mark Turnidge's wife and I agree with you and as you know, 100's of us have signed your petition. Thank you for bringing up my husband on here and what happened to him. I fully agree and hope the word gets out on matters like these because up until now, I was clueless.

I hope our signings on your petition have helped and I think I could get many more if I attempted at it again by reposting on facebook and my own caringbridge website. I'd LOVE to have the opportunity to talk with you personally as well. You can find me on facebook by my name.

Wendy

Jill,

Thanks for all YOU are doing. I have a benefit in place for Mark for September 13, 2009 at Majestic Oaks Country Club in Blaine, MN. If you google Mark Turnidge Death, it comes up on Scribb to download the flyer and newsletter I created with a ton of pics, including ones up to his death and on life support at the hospital.

You can find him on facebook too (his Memorial page) by searching facebook for Mark Turnidge Memorial Group. If that doesn't work, you can email me too.

Thanks Jill.

Wendy
