Automobile Accidents Involving Cell Phones-A Growing Problem

So many drivers these days are talking on the phone while driving. Studies have shown that talking on the cell phone while driving is very close to the danger of driving while drunk. The reason is that your mind is taken up with your conversation and not 100 percent focused on the road.

It is the slight lapses in focus that lead to car wrecks. In litigation over car wrecks causing personal injuries, all of our written discovery questions to defendants incude a request for production demanding that they provide us a copy of their cell phone bill for the date of the accident. That way we can find out if they were on the phone at the time. Juries will be much more generous to an injured person, if they feel the defendant committed conduct which is irresponsible. Most of us would find causing an accident while talking and driving to be even worse than ordinary mistakes while operating a car on the road.
